Drum Solo Studio Song Service Terms

Version 1. Effective from 16 October 2026.

These terms govern the Drum Solo Studio feature that removes the drums from a song of yours and turns it into a lesson ("the service"). You accept them in the app by ticking the two boxes shown before your first song is processed. If you do not agree, do not use the service: the rest of the app keeps working as before.

The app's general terms of use, the privacy policy and the Google Play or App Store terms continue to apply. Where these terms say something different about the song service, these terms prevail.

1. Who provides the service

The service is provided by Batalsoft, whose full details are set out in section 17. In these terms, "Batalsoft", "we" and "us" refer to its owner.

2. What the service is

  1. You choose a song stored on your phone. The app sends it to our servers, an automated system separates the drums from the other instruments and creates a lesson from the drum hits it detects. You receive on your phone the song without drums and the lesson, to play along to.
  2. Processing takes place on our own servers and on Google Firebase (Google Cloud). On some phones with enough capacity, the app may do part of the work on the phone itself using the same system; for the purposes of these terms that is the same thing, and the song counts towards your allowance in the same way (section 6).
  3. The output is generated by an artificial intelligence system. It is an edit of your own song, not new content.

3. The output is not guaranteed

  1. Removing the drums and detecting the hits is done by a machine. The output may not be perfect: traces of drums may remain, other instruments may be cut, the lesson may contain extra, missing or misplaced hits, and the detected tempo may not match the real one. Some songs come out very well and others poorly, and there is no way to know in advance which.
  2. We do not guarantee any level of quality of the output, nor that it will be fit for any particular purpose. We tell you this expressly before your first song is processed and you accept it by ticking a separate box. If you live in the European Union, that acceptance is the one provided for in Directive 2019/770 (article 8(5)): you know the output may not meet what would normally be expected of a product of this kind, and you accept it.
  3. A processed song with an imperfect result counts as used and is not replaced or refunded, except as required by the law that protects you (section 12 for the European Union). If the service fails for a reason attributable to us and you receive no output at all, the song is not deducted.

4. Your songs

  1. You may only upload songs you have the right to use for this purpose: your own, those under a licence that allows it, or copies that the law of your country lets you use for private practice. You are the one who knows, and you warrant that this is the case every time you upload one.
  2. The output is for your personal, private practice: playing the drums along to the song. Do not distribute it, publish it, sell it or use it in performances or recordings unless you hold the rights to do so. We give you no rights over the original song that you did not already have.
  3. You keep all your rights in what you upload and in the output. You grant us only the permission needed to provide the service: to receive the file, copy it, process it, store it for as long as strictly necessary and send you the output. That permission ends as soon as the file is deleted (section 5).
  4. We do not use your songs to train models, nor for anything other than processing them for you. They are not shared with other users, not published and not sold. Nobody listens to them.
  5. You are responsible for what you upload. If a third party (the author, the record label, the publisher) makes a claim over a song you uploaded without the right to do so, the liability is yours. To the extent permitted by applicable law, you will hold us harmless from those claims and from the reasonable costs they cause us, including legal fees. If you are a consumer in the European Union or the United Kingdom, this applies as set out in section 12.
  6. We may remove, without prior review, any file we have reason to believe infringes rights, and suspend the service for anyone who does so repeatedly (section 7).

5. How long we keep your songs

  1. The audio you upload is deleted once processing is complete. The output is deleted from the server as soon as the app downloads it. Anything left behind because of a failure is deleted automatically within 48 hours at most.
  2. We keep no copy. The drumless song and the lesson exist only on your phone. If you delete them, change phone or reinstall the app, we cannot give them back: the song would have to be processed again, and it would count again. Make your own backups.
  3. Everything else that is stored (a song counter per device or per subscription, and a record of each processing job without the audio), why and for how long, is set out in the privacy policy: https://batalsoft.com/privacy-policy.htm.

6. Free songs and subscription

  1. Free songs. Each phone gets 2 free songs in total, not per month. They are per device, not per person, and do not transfer from one phone to another. They are a sample, and we may change their number for new users.
  2. Subscription. With the Drum Solo Studio subscription you can process up to 30 songs per subscription period, counted from the day you subscribed (if you subscribe on the 14th, the allowance renews on the 14th of each period). Songs you do not use in one period do not carry over to the next. The subscription also includes whatever the store states when you subscribe (no ads, all lessons).
  3. The app's one-off Premium purchase does not include songs: it has the same 2 free songs, because each song costs server time every time.
  4. The subscription is charged and managed by Google Play or the App Store, depending on where you downloaded the app. The price is the one the store shows in your country at the time you subscribe, taxes included; the store will notify you of any price change before it affects you. It renews automatically at the end of each period unless you cancel it, and it is cancelled from the store itself (on Android: Google Play, Subscriptions; on iPhone: Settings, your name, Subscriptions) at least 24 hours before the period ends. We cannot cancel it or refund you on the store's behalf.
  5. Refunds. They are handled by the store under its own rules (Google: https://support.google.com/googleplay/answer/2479637; Apple: https://support.apple.com/HT204084). Whatever the law that protects you says prevails (section 12).
  6. Free trial. If the store offers a free trial of the subscription, its conditions (length and what happens when it ends) are those the store shows when you subscribe. When the trial ends, the normal price is charged unless you cancel first.
  7. If the store stops recognising your subscription (non-payment, cancellation, refund), the service treats you again as a user without a subscription.

7. Limits, prohibited uses and suspension

  1. There is a daily cap on free songs across all users and a queue: the app tells you how many songs are ahead of yours and how long it will take. Subscription songs have priority. If the cap is reached, you can try again the next day.
  2. Each song may last up to 10 minutes and be up to 20 MB in size. If it exceeds them, the service rejects it, the app tells you why and the song does not count against your quota. These limits may change (section 8).
  3. You may not:
    • upload songs you do not hold rights to (section 4);
    • tamper with the app, the free song counter or the communication with the server; use a modified app, emulators or automation to process songs;
    • use the service from any app or program other than Drum Solo Studio;
    • extract, copy or attempt to reproduce our artificial intelligence models, including those the app downloads to your phone for local processing;
    • resell the service or the output, or build a service on top of it;
    • use the service for anything unlawful or harmful to third parties.
  4. If you breach these terms, we may suspend or terminate the service on your device or your subscription, with or without notice depending on the seriousness. If you live in the European Union and we terminate the service while you have a current subscription because of your breach, you are not entitled to a refund for the remaining time, except as required by law.
  5. We have no obligation to review what you upload, but we may do so if there is a complaint or a suspicion of abuse.

8. Availability and changes to the service

  1. We try to keep the service available at all times, but we do not guarantee that it will be. It may stop for maintenance, breakdowns, failures of our providers (Google Firebase, your carrier) or causes beyond our control. Whenever we can, the app warns you before you upload the song.
  2. We may change the service (the system that performs it, the limits, the quality, which devices support it) and withdraw it, giving at least 30 days' notice in the app. If we withdraw it while you have a current subscription, we refund the proportional part of the period already paid that you cannot use: on Google Play we do it ourselves; on the App Store, which does not let us issue refunds, we tell you how to request it from Apple.
  3. Old versions of the app may stop being able to use the service. Keep the app up to date.

9. Age

  1. You must be at least 13 years old to use the service. If you are a minor in your country, you need the permission of a parent or guardian, who accepts these terms on your behalf and is responsible for what you upload.
  2. The service is not directed at children and we do not knowingly collect data from children under 13. If you believe a child has used it, write to [email protected] and we will delete whatever we hold.

10. What is ours

  1. The app, the service, the artificial intelligence models (including those the app downloads encrypted to your phone), the app's own lessons and its trademarks belong to Batalsoft or its licensors. We grant you a personal, non-exclusive, revocable licence to use them within the app, and nothing more.
  2. What is yours (your songs and the output) remains yours (section 4).
  3. If you send us suggestions about the service, we may use them with no obligation to you.

11. Disclaimer of warranties and limitation of liability

This section applies to the extent permitted by applicable law. If you are a consumer in the European Union, the United Kingdom or Switzerland, it applies only insofar as it does not contradict section 12. If you are in the United States, also read section 13.

  1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". WE DO NOT WARRANT THAT THE OUTPUT WILL BE OF ANY PARTICULAR QUALITY OR FIT FOR ANY PARTICULAR PURPOSE, THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT IT WILL BE AVAILABLE AT ANY GIVEN TIME.
  2. WE ARE NOT LIABLE FOR INDIRECT, UNFORESEEABLE OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, DATA OR OPPORTUNITIES, ARISING FROM THE USE OF THE SERVICE OR THE INABILITY TO USE IT, OR FROM CONTENT UPLOADED BY USERS.
  3. OUR TOTAL LIABILITY FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO IT WILL NOT EXCEED WHAT YOU PAID FOR THE SUBSCRIPTION IN THOSE TWELVE MONTHS OR, IF YOU PAID NOTHING, 20 EUROS.
  4. Nothing in this section excludes or limits liability that the law does not allow to be excluded: liability arising from wilful misconduct or gross negligence, for personal injury, and any liability your consumer law grants you.
  5. Our providers (Google, Apple) are not liable to you for the service, except as stated in section 15.

12. If you are a consumer in the European Union, the European Economic Area, the United Kingdom or Switzerland

  1. Your consumer rights are unaffected. Nothing in these terms removes the rights granted to you by the law of the country where you live that cannot be waived by contract (in the European Union, those protected by article 6 of the Rome I Regulation). If any clause of these terms contradicts them, the law prevails for you.
  2. Liability. We are liable to you for damage caused by our wilful misconduct or gross negligence, for damage to life, health or physical integrity, and for any damage that cannot be excluded under your law. We are not liable for indirect damage or for damage that was not foreseeable when you accepted these terms. The amounts in section 11.3 apply to everything else.
  3. Conformity of the output. Before your first song is processed, we inform you expressly and separately that the output is made by a machine and may not be perfect, and you accept this with its own tick box. That acceptance is the one provided for in article 8(5) of Directive 2019/770 on digital content. Everything else that law grants you (for example, that the service is the one described in section 2 and that you receive the output) remains in place.
  4. Right of withdrawal. You purchase and pay for the subscription through Google Play or the App Store. Withdrawal and refunds are handled by that store, under its terms and any rights your local law gives you. Free songs have no price, so there is nothing to refund.
  5. Complaints. Write to [email protected]; we reply within a reasonable time and at most within one month. If you are not satisfied, you may turn to the consumer authorities of your country or to an alternative dispute resolution body for consumer matters. We are not committed to any specific body. In Spain: complaint forms and the consumer directorate of your autonomous community.
  6. Courts. You may sue us in the courts of the country where you live, and we may sue you only there.
  7. Language. The full terms are available in Spanish and English. The summary you see in the app before accepting is in your phone's language, among those the app supports. If your language is not among them, ask us for what you need at [email protected].
  8. Data protection. What we do with your data, the legal basis, the transfer to the United States and your rights (access, rectification, erasure, objection, portability, complaint to your supervisory authority) are set out in the privacy policy.

13. If you are in the United States

  1. Warranties. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ITS OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE OUTPUT WILL BE ACCURATE OR COMPLETE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
  2. Liability. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE, AND OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNTS STATED IN SECTION 11.3. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR THE LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
  3. Age. You must be at least 13 years old, under the Children's Online Privacy Protection Act (COPPA). Between 13 and 17, the permission of a parent or guardian is required.
  4. Copyright notices (DMCA). If you are a rights holder and believe someone has used the service with a work of yours without permission, write to [email protected] with the subject "Copyright notice" and include: your physical or electronic signature; the work you believe is infringed; information that allows us to identify the use you are reporting (bear in mind that we do not keep the songs, section 5); your contact details; a statement that you believe in good faith that the use is not authorised; and a statement, under penalty of perjury, that the information is accurate and that you are the rights holder or are authorised to act on their behalf. We act on complete notices, terminate the service for repeat infringers and keep a record of the notice. Anyone who knowingly misrepresents a claim is liable for the damage caused (17 U.S.C. § 512(f)).
  5. No mandatory arbitration. We do not require you to arbitrate and you waive nothing by accepting these terms. If there is a dispute, we talk first ([email protected]) and, if it is not resolved, section 16.5 applies.
  6. California users. Under section 1789.3 of the California Civil Code, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, telephone (800) 952-5210.
  7. Export controls. You represent that you are not located in a country subject to a United States embargo and are not on any list of prohibited or restricted parties.

14. If you are in any other country

  1. You are responsible for ensuring that using the service is lawful where you live. If it is not, do not use it.
  2. If the law of your country grants you consumer rights that cannot be waived, you have them, and these terms apply insofar as they do not contradict them.
  3. The data protection laws of your country (for example, Brazil's LGPD, the California privacy law or the UK GDPR) are addressed as set out in the privacy policy. If your law grants you a right that is not listed there, write to us.

15. If you use the app on an iPhone or iPad

Apple requires these terms to state the following for iOS users:

  1. These terms are between you and us, not Apple. Apple is not responsible for the app or the service, or their content.
  2. The licence to use the app is the one granted by Apple in its App Store terms, limited to Apple devices you own or control and to Apple's usage rules.
  3. We, not Apple, are responsible for maintaining and supporting the app. Apple has no obligation to provide support.
  4. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app, if you paid one. Apple has no other warranty obligation.
  5. We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or the service, including product liability claims, claims that the app fails to comply with legal or regulatory requirements, consumer protection claims and intellectual property claims.
  6. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
  7. The export control representation in section 13.7 also applies to you.

16. General provisions

  1. Changes to these terms. We may change them. If the change is material, the app notifies you and asks you to accept the terms again before processing another song; until you accept, no song is processed. For a current subscription, changes that are to your detriment do not apply until the next renewal, and if you do not accept them you may cancel.
  2. Termination. You may stop using the service at any time. We may terminate it for breach (section 7) or withdraw it (section 8). Sections 4, 5, 10, 11, 12, 13 and 16 survive termination.
  3. Severability. If a clause is not valid in your country, it applies to the extent it is valid, or is replaced by the closest provision the law allows, and the rest of the terms remain in force.
  4. Assignment. We may assign these terms to whoever continues the business, with notice to you. You may not assign them.
  5. Governing law and courts. These terms are governed by Spanish law. The courts of Spain have jurisdiction over any dispute, unless you are a consumer and your law allows you to go to the courts of your own country (sections 12.6 and 14.2).
  6. Language. If there are differences between the Spanish and English versions of these terms, the Spanish version prevails, unless you are a consumer and your law provides otherwise.
  7. Notices. You can write to us at [email protected]. We notify you within the app.
  8. Our failure to enforce a clause on one occasion does not mean we waive it.

17. Who provides the service and contact

The service is provided by Batalsoft, the trade name of Antonio Lara Vega, tax ID 80065585D, with business address at Avda. Pardaleras 4, 1.º B, 06003 Badajoz, Spain. Email: [email protected].

  2. No guardamos copia.

  3. No está permitido:
    • subir canciones sobre las que no tengas derechos (apartado 4);
    • manipular la app, el contador de canciones gratis o la comunicación con el servidor; usar la app modificada, emuladores o automatismos para procesar canciones;
    • usar el servicio desde otra app o programa que no sea Drum Solo Studio;
    • extraer, copiar o intentar reproducir nuestros modelos de inteligencia artificial, incluidos los que la app descarga a tu móvil para procesar en local;
    • revender el servicio o el resultado, o montar un servicio sobre él;
    • usar el servicio para algo ilegal o que dañe a terceros.

13. Si estás en Estados Unidos

  1. Garantías.
  2. Responsabilidad. Some states do not allow these limitations, so some of them may not apply to you.
  3. Edad.
  6. Usuarios de California. Según el artículo 1789.3 del Código Civil de California, puedes dirigirte a la Complaint Assistance Unit de la Division of Consumer Services del California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, teléfono (800) 952-5210.

Tú no puedes cederlas.
  5. Ley y juzgados.
